The Performers’ Rights Society of the Philippines (PRSP) and the Sounds Recording Rights Society, Inc. (SoundsRight) signed a memorandum of agreement last April 19 to ensure the collection of royalties for both record producers and artists/performers.
The PRSP and SoundsRight are accredited by the Intellectual Property Rights Office of the Philippines to function as collective management organizations (CMOs), representing performers and producers, respectively.
The MOA was drafted pursuant to Section No. 209 of the Intellectual Property Code of the Philippines which states that “if a sound recording is used for commercial purposes, or publicly performed with the intention of making or enhancing profits, a single remuneration for the performer and the producer of the sound recording shall be paid by the music user to both the performer and the producer.”
The MOA will ensure that the rights of copyright holders are enforced and making payments simpler for music users. It also provides a system of joint collection by SoundsRight and PRSP of revenues from the users who are licensed to broadcast, communicate to the public or publicly perform sound recordings under section 209 of the Intellectual Property Code.
Under the MOA, SoundsRight shall use its collection infrastructure to conduct the practical collection for its own behalf and on behalf of PRSP.
The PRSP acts as the collecting society of performers (actors, musicians, dancers, etc.) whose works are used for commercial broadcast and other ways of communications to the public to gain profit. It is composed of the following member guilds and organizations:
*OPM (Organisasyon ng Pilipinong Mang-aawit)
*KAPPT (Katipunan ng mga Artista sa Pelikulang Pilipino at Telebisyon)
*AMP (Asosasyon ng Musikong Pilipino)
*Philstage (Philippine Legitimate Stage Artists Group, Inc.)
*FAP (Film Academy of the Philippines)
The PRSP board of trustees is composed of Leo Martinez, chairperson; Mitch Valdez, president; John Lesaca, treasurer and acting general manager; Trina Belamide and Fernando Josef, board members.
SoundsRight is a non-stock, non-profit organization established in November 2013 by the Philippine Association of the Record Industry (PARI). It is an IPOPHIL-accredited collective management organization authorized to issue licenses for the commercial use of sound recordings owned by member record producers in the country.
The SoundsRight officers are: Ramon S. Chuaying, chairman; Marivic A. Benedicto, president; Alvin F. De Vera, vice-president Internal; Howard G. Dy, vice-president External; Johnny K. Sy, treasurer; Lachmi D. Baviera, secretary; and Rene A. Salta, auditor.
